New Jersey Workers’ Compensation Claims
If you are injured or become ill on the job, you may be eligible to receive three different types of benefits under New Jersey workers’ compensation law – regardless of who is at fault:
- Medical Benefits: These benefits cover your medical expenses. Your employer must pay for all medical treatment that is necessary “to cure and relieve” the effects of your workplace injury or illness, including emergency care and rehabilitation. The employer’s liability ceases after $50, so you must petition for medical expenses to be paid beyond that amount. The employer may choose a physician to provide your treatment and may reject paying your medical bills if your physician is unauthorized.
- Temporary Total Disability (TTD) Benefits: These benefits cover your lost income. After a one-week waiting period, you can file a claim for up to 70 percent of your gross weekly wage (the amount before deductions) if your injury or illness prevents you from working until you fully recover. You may be able to receive weekly payments ranging from $212 to $794 for up 400 weeks.
Permanent Disability Benefits: These benefits provide up to 70 percent of your gross weekly wage. They fall under two categories:
- Permanent Partial Disability (PPD): These benefits are paid where your disability prevents you from ever working again at full capacity. Payments can range from $35 to $794 per week and last for up to 600 weeks or $476,400. If you have suffered an amputation, an additional 30 percent may be added to the award.
- Permanent total disability (PTD): These benefits are paid where you cannot work again because of the injury or illness you suffered on the job. You can receive weekly payments between $212 to $794 for up to 450 weeks or, in some cases, for life.
If the work-related injury or illness results in death, the employer must pay for all funeral expenses as well as death benefits that cover up to 70 percent of the deceased worker’s average weekly wage. These payments to the worker’s dependents may last for up to 450 weeks or until the dependent turns 18 (or 23 if enrolled as a full-time student).
Third-Party Personal Injury Lawsuit
New Jersey workers’ compensation law generally bars you from suing your employer. But you are not prevented from filing a personal injury lawsuit against a third party who caused your accident or injury. Unlike a workers’ comp claim, you must prove fault. However, you can recover compensation for not only your medical expenses and lost wages but also your pain and suffering and any punitive damages.
Additionally, a worker’s family may, in some cases, be able to sue the employer for their own unique injuries. For instance, a worker’s children may be able to sue for birth defects caused by an illness the worker contracted after being exposed to a hazardous chemical at the workplace.
