Marc C. Marc C. Saperstein is a founding partner of the New Jersey personal injury law firm Davis, Saperstein & Salomon, P.C. and in addition to his New Jersey practice, he heads the firms New York Personal Injury Practice Group. Early in his career, he filed class actions and product liability lawsuits against Big Tobacco for the harm caused by cigarettes.  His efforts contributed to the national settlement which caused changes to Big Tobacco’s marketing practices.  At the same time Saperstein filed lawsuits and class actions against American Home Products for injuries caused by its defective diet drugs Phen-Fen and won settlements in both New Jersey and New York.

$20 Million Settlement – NYC Motor Vehicle Accident

The defendant, a drunk driver, was traveling eastbound when he ran a steady red light, striking a taxi traveling northbound. The force of the crash ejected the client who was a rear seated passenger through the taxi window. The client suffered severe traumatic brain injury, spinal fractures, and even required a ventriculoperitoneal shunt.

$9 Million Settlement – NYC Slip and Fall

This team settlement was secured for a young man who fell into a hole on a New York City subway platform. The incident caused catastrophic injuries and resulted in the amputation of both legs.

$6.2 Million Combined Settlement – Multi-Client School Bus Crash

This combined settlement, totaling $6.25 million, was obtained on behalf of six schoolchildren we represented who were injured in the catastrophic school bus crash on Interstate 80 in Mount Olive, New Jersey. The collision between the school bus and dump truck caused severe physical injuries and emotional trauma to student and teacher passengers, and the investigation confirmed that the school bus driver attempted an illegal U-turn that caused the crash. Among the students we represented were children who suffered serious lasting injuries, including significant emotional trauma such as PTSD, as a result of the violent impact.

$4 Million Settlement – Construction Site Injury

Construction site accident involving a worker who fell from a multi-story commercial building. The worker suffered a fractured skull, fractures to the right leg and arm, and a severe spinal cord injury.

$4 Million Combined Settlement – Multi-Client Pedestrian Accident

Two pedestrians were struck while crossing toward a casino entrance by a valet attendant who admitted he did not know how to operate the vehicle’s handicap hand controls before attempting to drive it. Both clients suffered neck injuries, and one required surgery for disc bulges caused by the crash.

$3.6 Million Settlement – Slip and Fall

Client was injured while exiting a commercial building’s lobby near the revolving doors. The evidence showed a carpet runner was placed in the walking path but was not properly secured, creating a dangerous trip hazard in a high-traffic area. The client suffered a disc bulge, a brain injury, and a small tear in the right knee.

$3.5 Million Settlement – Wrongful Death

was secured for the family of a pedestrian who was struck and killed while crossing at an intersection in Englewood, New Jersey, when a jitney bus failed to see her. The collision caused fatal injuries and led to a wrongful death recovery on behalf of her loved ones.

$3.1 Million Settlement – Workplace Slip and Fall

Client fell from a roof while in the course of employment and fractured the left patella. The injury was severe and ultimately required total knee replacement surgery.

Client fell while walking from her car toward her workplace entrance after her sandal heel caught on exposed steel rebar sticking up from the surface. She suffered an annular disc bulge that caused pain in the lower back and radiating leg pain.

A settlement was secured for a construction worker who was hurt on a job site after stepping onto a loose piece of wood that had been placed over a large hole. The cover shifted and the client fell through, suffering a serious elbow injury and a disc bulge that required surgery.

$2.9 Million Settlement – New York City Slip and Fall

Client tripped in the street after walking under scaffolding and stepping onto uneven cobblestones. The evidence showed loose, unstable stones created a dangerous walking surface. The case focused on poor maintenance and the failure to repair a known hazard in a heavily traveled area which caused a severe injury to the client’s right elbow.

$2.8 Million Settlement – Workplace Premises Liability

The plaintiff was leaving work in a building lobby that was dimly lit and had been made even more dangerous when the construction team turned off the lights at the end of the day. As employees were exiting, he slipped on cardboard and fell over construction debris, suffering a serious knee injury that required emergency surgery.

$2.2 Million Settlement – Motor Vehicle Accident

Client was in traffic due to construction when he was struck from behind and pushed into the vehicle ahead. The case focused on distracted negligent driving in stop-and-go conditions as well as the neck injuries caused by the preventable chain-reaction crash.

Day Care Center left an unsupervised employee to care for an infant, who admitted to shaking the child aggressively while frustrated. The child suffered severe brain damage and complete blindness as a result of this horrible negligence.

The client suffered neck and back injuries when his vehicle was struck by a forklift that was backing up. The claim focused on basic safety failures and the duty to operate equipment carefully around nearby vehicles and pedestrians.

The plaintiff was riding a motorcycle with the green light when a police vehicle traveling at a high rate of speed went through a red light and struck him, throwing him across the right lane of Route 23 North. $2.1 Million Settlement – Wrongful Death

This settlement was secured for the family of a 28-year-old woman who was killed while driving to work on Route 80 in New Jersey when a wheel rolled off a westbound tractor-trailer and struck her vehicle. The case involved an improperly maintained truck, and the evidence showed the wheel had overheated, came loose, and bounced into the roadway, causing fatal injuries.

$1.9 Million Settlement – Pedestrian Accident

Recovery for a pedestrian who was struck in the parking lot of an apartment complex by a vehicle making a careless left turn that hit her as she walked across the lot. The lack of basic driver responsibility caused serious injuries such as a broken hip that required surgery among other injuries.

$1.7 Million Settlement – Product Liability

A settlement was won for a worker who was injured while clearing material from an industrial roller. The worker crawled underneath the roller to clear buildup, when his brush became caught between rollers and pulled his shoulder into the pinch point, causing multiple fractured ribs and 3rd degree burns on his back. The claim centered on machine safety and the failure to protect workers from a known high-risk hazard that causes serious injuries.

$1.6 Million Settlement – Worksite Slip and Fall Accident

PSE&G employee tripped outside of worksite when her shoe got caught in concrete grout lines causing her to fall and strike her head, knee, and shoulder, along with hand abrasions as she tried to break the fall. This resulted in multiple disc bulges and neck and back injuries.

$1.6 Million Settlement – Motor Vehicle Accident

The client was travelling down Route 80 east, in New Jersey when a truck travelling on Route 80 west lost two of its wheels. The tires crossed the highway, first striking another vehicle, and then the clients causing lower back injuries, pain, and PTSD due to the negligent malfunction.

$1.6 Million Settlement – New York Premises Liability

While going down a staircase from the second to the first floor, the client fell due to a broken hallway lighting that caused the stairwell to be extremely and dangerously dark. The fall caused fractures to the right leg and ankle and required multiple surgeries.

$1.5 Million Settlement – New York Motor Vehicle Accident

The client was a passenger in a vehicle that was rear-ended while stopped at a red light on Jamaica Avenue in Queens, New York while waiting to turn onto the Van Wyck Service Road. The crash happened without warning and caused a significant rotator cuff injury that required surgery, multiple disc bulges, and other injuries that require rehabilitation and long-term losses.

$1.5 Million Settlement – Pedestrian Accident

The pedestrian client finished crossing a street and was preparing to enter their own car when a speeding driver struck them. The impact threw the client onto the pavement and caused serious injuries that required back surgery due to the severity of the impact.

An inattentive driver changed lanes without properly checking their mirrors triggering a chain reaction involving multiple vehicles. After colliding with one car, the negligent driver swerved back, sideswiped another vehicle, and ultimately rear-ended the client. An out-of-court settlement was secured for a client who was injured at a national hardware store while lifting a boxed toilet from a high steel shelf. Because the bottom of the box had not been properly taped, the toilet fell through onto his right foot, causing multiple fractures and other injuries.

This settlement was secured for the family of a worker who died from asphyxiation while working in a boiler room. The recovery addressed the profound losses suffered by his loved ones as a result of this tragic and preventable incident.

The client was a passenger in a car traveling in the left lane of Route 21 when a large truck suddenly came into the lane. The back of the truck struck the passenger side door of the car. The crash resulted in the client suffering a fractured left leg, a dislocated shoulder, as well as other serious injuries.

The defendant driver approached stopped traffic and attempted to change to the right lane without enough space, resulting in him crashing into the client’s truck. The impact caused disabling damage to the vehicles and led to the client sustaining serious injuries such as a traumatic brain injury, a right shoulder tare, and multiple disc bulges that required surgery.

$1.2 Million Settlement – Motorcycle Wrongful Death

A Rockland County, New York settlement was won for the family of a client involved in a fatal motorcycle crash. A negligent driver attempted a U-turn on a bend directly in the motorcyclist’s path, causing fatal injuries.

The client was suddenly rear-ended by a negligent cement truck driver while traveling in the left lane of Route 46. The incident caused two impacts, the initial impact and a second collision as the client attempted to pull over. The client suffered injuries to his neck, shoulders, legs, and back including disc bulges that required injections.

The collision occurred when the defendant driver attempted to make a left turn in front of the client’s vehicle causing a crash. The client was traveling in the center lane of the New Jersey Turnpike when a tractor-trailer moved into the lane from the left and sideswiped his vehicle. The client was injured at a gas station where a driver entering the station swerved to avoid another vehicle that was exiting the station when they lost control striking the client where he was standing filling his car with gas. This caused serious catastrophic injuries to his left leg that resulted in it almost being amputated.

Settlement was won for worker who suffered extreme injuries after his hand and arm became caught in a roller while operating a frame machine. The equipment lacked basic safeguards, including a proper guard and an emergency shutoff within reach focusing the case on the preventable design and safety failures.

A USPS mail carrier fell on an icy sidewalk in front of a residential driveway. The investigation proved that the sidewalks’ icy condition had been an ongoing problem and was previously reported to management before the incident. The worker suffered injuries to her tibia and fibula as well as to her ankle, which required surgery.

$1 Million Settlement – NJ Transit Bus Accident

This settlement was secured for a passenger who was injured when her New Jersey Transit bus rear-ended another NJ Transit bus. The force of the impact caused her to strike her face on a bar near the window, resulting in a concussion, lacerations, disc bulges, and pain in her neck, back, knee, and feet that made walking difficult.
