A woman suffered serious injuries after being struck by a box truck making an improper U-turn on the roadway while driving along I-287 in Mahwah, New Jersey. She hired Davis, Saperstein & Salomon, P.C., and Partner Adam B. Lederman filed suit in the Superior Court of New Jersey, Bergen County.
After experiencing injuries to her neck, back, and right shoulder, our client sought medical treatment and was diagnosed with disc bulges in her cervical spine and lumbar spine, and a labral tear in her shoulder. For treatment, she underwent months of physical therapy for her spine and an arthroscopic surgery with labral repair for her shoulder.
Davis, Saperstein & Salomon, P.C. hired medical experts to author narrative reports describing the woman’s injuries and their permanent nature. With the help of these experts, Partner Adam Lederman successfully sued the truck driver for driving carelessly and obtained a $250,000 settlement for our client’s injuries, pain, and suffering.
Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.

Medical Glossary
Arthroscopy: Arthroscopy is a minimally invasive surgical procedure where a small camera and specialized tools are used to diagnose and treat problems within a joint, such as the knee, shoulder, or hip. It allows surgeons to visualize and address issues like injuries or damaged tissues with smaller incisions and a faster recovery compared to traditional open surgery.
Cervical spine: The first seven vertebrae in the spine.
Disc bulge: Bulging discs are a condition in which the inner portion of a spinal disc remains contained in the outer portion of a spinal disc. The outer shell often becomes weaker, and the disc begins to bulge to one side of the spinal canal or flatten. Many experience bulging discs after an injury.
Labral tear: A tear in the labrum in the shoulder.
Lumbar spine: The lower back; consists of five bones.
