Over $1 Billion in Verdicts and Settlements

Pedestrian Hit by Car – $630,000 Settlement

In Edgewater, New Jersey, while a woman was crossing a parking lot as a pedestrian, she was struck by a car. Davis, Saperstein & Salomon, P.C. Partner Samuel L. Davis filed suit in the Superior Court of New Jersey, Bergen County, proved that the driver was negligent in failing to properly observe the pedestrian, and won the client a $630,000 settlement.

The client was crossing the parking lot at an intersection controlled by four-way stop signs with stop lines when she was knocked to the ground and lost consciousness. She was taken by ambulance to Englewood Hospital in NJ for evaluation and treatment.

The client suffered fractures to the left side of her body, including her hip, rib, and elbow. She also suffered from a torn triceps tendon, which required surgery to repair. She required months of physical therapy to treat her other injuries. As a result of the incident, our client also developed post-traumatic stress disorder (PTSD) and adjustment disorder.

Davis, Saperstein & Salomon, P.C. hired medical experts to author narrative reports explaining the client’s injuries and their permanent nature. Proving that her injuries were permanent helped personal injury attorney Samuel L. Davis sue for monetary compensation, forcing the negligent driver’s insurance company to settle.

Partner Samuel L. Davis sued the driver in the Bergen County Superior Court and won proper compensation for our client’s injuries, including her physical and emotional pain and suffering, in the form of a $630,000 settlement.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances, and available insurance coverage.
