Largest Reported NJ Personal Injury Settlement during the Court’s 2022-2023 term

Rear-End Collision—$750,000 Settlement

In Hollis, New York, a mother of three stopped at a red light and was rear-ended by a bus. The woman hired Davis, Saperstein & Salomon, P.C. partner Marc C. Saperstein to represent her in her personal injury lawsuit. Attorney Marc C. Saperstein proved that the bus driver had been careless, reckless, and negligent, and our client won a $750,000 settlement.

The client stopped at the red light located on the intersection of Hillside Avenue and 188th Street. Her three children and mother were also in the car. The light had just turned green when she was rear-ended by a bus, and her car was caused to clear the entire intersection. Our client and each of the three passengers were taken by ambulance   nearby to North Shore University Hospital in Manhasset, New York.

Personal injury lawyer Marc C. Saperstein hired an accident reconstruction expert to determine the speed that our client’s vehicle moved after being rear-ended. Using a variety of variables, including the width of impact, the expert witness calculated that our client’s vehicle had been flung forward at a speed of at least 10 mph. Partner Marc C. Saperstein sued the bus company in the New York Superior Court for the injuries, financial loss, and pain and suffering caused to our client.

Our client suffered permanent damage to her spine. She was diagnosed with a disc herniations and bulges throughout her cervical and lumbar spines.  Her doctors found radiculopathy or pain radiating into her extremities.   She tried conservative treatment, including chiropractic therapy, physical therapy, and acupuncture. She also received a series of epidural steroid injections. After those treatments did not alleviate her symptoms, she underwent an anterior cervical discectomy and fusion at the C5-C6 level.

Davis, Saperstein & Salomon, P.C. partner Marc C. Saperstein ensured that the firm’s client received proper compensation for her pain and suffering in the form of a $750,000 settlement.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
