Over $1 Billion in Verdicts and Settlements

Woman Slips and Falls on Ice — $400,000 Settlement

While walking with her daughter, a woman slipped and fell on uncleared ice covering the sidewalk of Summit Avenue in Union City, New Jersey. Davis, Saperstein & Salomon, P.C. Partner Steven Benvenisti filed suit in the Superior Court of New Jersey, Hudson County, sued the property owners and businesses who own and maintained the sidewalk, and won her a $400,000 settlement.

The woman was taken to Hudson Regional Hospital in Secaucus, New Jersey, suffering from injuries to her left wrist, back, and right shoulder, including a distal radius fracture, bulging discs in her lumbar spine, and a SLAP tear. For her wrist fracture, the client underwent an open reduction and internal fixation (ORIF) surgery. Her back required pain patches and her shoulder required a cortisone shot.

Benvenisti hired medical experts to examine the injured client and author narrative reports describing the client’s injuries and their permanent nature. Davis, Saperstein & Salomon, P.C. also hired an engineering expert to help Partner Steven Benvenisti prove that the businesses were legally reponsible for not clearing the ice. The expert found that the businesses had failed to clear melting snow, which when melted refroze to black ice as the temperature fell below freezing again, causing the client to slip and fall on the black ice.

With the help of these experts, Davis, Saperstein & Salomon, P.C. Partner Steven Benvenisti ensured that the client was fully compensated for her injuries, pain, and suffering, in the form of a $400,000 settlement.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.

Medical Glossary

Cortisone shot: A steroid injection that can help relieve pain, swelling, and/or irritation in a targeted area of the body.

Distal radius fracture: A break in the radius bone, which is one of the two long bones in the forearm.

Disc bulge: Bulging discs are a condition in which the inner portion of a spinal disc remains contained in the outer portion of a spinal disc. Lumbar spine: The lower back; consists of five bones.

Open reduction and internal fixation (ORIF): A type of surgery used to stabilize and treat a broken bone. The procedure involves two steps: “open reduction” involves a surgeon creating a small incision in order to access the bone, and “internal fixation” involves a surgeon putting the bone back together with hardware like metal pins, plates, rods, or screws.

Superior Labrum Anterior to Posterior (SLAP) tear: An injury to part of the labrum of the shoulder. The labrum is a ring of cartilage surrounding the shoulder joint socket.
