In Hanover Township, New Jersey, a man was rear-ended when he slowed to make a right-hand turn off Route 10 onto 903 Route 10. Davis, Saperstein & Salomon, P.C. Partner Samuel L. Davis filed suit in the Superior Court of New Jersey, Bergen County, proved that the rear-ending driver was negligent in his failure to properly observe the road, and won our client a $500,000 settlement.
The client was driving east on Route 10 in the right lane when he slowed and activated his right-hand signal to show that he was turning. At the same time, a large panel truck behind him was not paying attention and rear-ended him. The client was taken by EMS to Morristown Memorial Hospital in NJ for evaluation and treatment.
The client suffered injuries to his neck, left shoulder, and left hand. He suffered disc bulges and disc herniations in his cervical spine, for which he underwent two epidural steroid injections, decompression surgery, and total disc arthroplasty. He also had several weeks of physical therapy.
Davis, Saperstein & Salomon, P.C. hired medical experts to author narrative reports explaining the client’s temporary and permanent injuries. This case was complicated by the fact that the client had a prior surgical history for his spine, so it was more difficult to prove that the automobile accident directly caused the client’s injury to his cervical spine. However, Partner Samuel L. Davis persevered and won our client a $500,000 settlement for his pain, suffering, and injuries.
Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances, and available insurance coverage.

Medical Glossary
Cervical spine: The cervical spine, also known as the neck region, consists of seven bones – C1-C7 vertebrae. They are separated from each other by intervertebral discs. If one of these vertebrae becomes misaligned, symptoms including neck pain, head pain, shoulder pain, and more can occur.
Decompression surgery: A procedure to alleviate pain caused by a pinched or compressed nerve. In medicine, decompression is obtained through the removal or repositioning of a structure that is compressing another structure. This surgery is usually only recommended when non-surgical treatment has not helped in alleviating pain and symptoms.
Disc arthroplasty: A surgical procedure involving the replacement of a degenerated spinal disc with an artificial one. The goal of this procedure is to reduce pressure on the spinal cord and/or its nerve roots.
Disc bulge: A condition in which the inner portion of a spinal disc remains contained in the outer portion of a spinal disc. The outer shell often becomes weaker, and the disc begins to bulge to one side of the spinal canal or flatten. Many experience bulging discs after an injury.
Disc herniation: Occurs when the exterior of a disc cracks and its nucleus pushes into the spinal canal and irritates surrounding nerves.
Epidural steroid injection: A minimally invasive procedure that can relieve neck, arm, back, and leg pain. The steroid calms down the irritated nerve that is causing the pain and swelling. Relief from the injections typically lasts for three months or more.
