Over $1 Billion in Verdicts and Settlements

Pedestrian Struck on Boulevard East in Weehawken, NJ – $5.1 Million Settlement

A pedestrian suffered life-changing injuries after being struck by a vehicle while crossing Boulevard East near Columbia Terrace in Weehawken, New Jersey. The crash caused severe head, spinal, orthopedic, and internal injuries, leading to extensive treatment, surgery, and a long recovery. Through detailed investigation and strong expert support, Davis, Saperstein & Salomon, P.C. Partners Steven Benvenisti, Esq., and Luis L. Haquia, Esq., secured a $5.1 million settlement for the injured pedestrian.

According to the crash investigation, the driver was traveling south on Boulevard East when he hit the pedestrian while negotiating a slight curve near the intersection, claiming he only saw a blur just before impact. Witness statements and later expert analysis, however, helped show the collision was preventable.

Witnesses described that the pedestrian was thrown forward and came to rest near a bus stop. When police arrived, our client was unconscious but breathing. Officers observed serious trauma at the scene, including a large head injury and a badly injured leg, and EMS noted possible ribinjuries and because of the severity of the crash, a detective was assigned to conduct a formal investigation.

The pedestrian was taken to Jersey City Medical Center in Jersey City, NJ, with catastrophic injuries, including a traumatic brain injury, brain bleed, fractures to the pelvis, ribs, and spine, a kidney injury, and serious right knee ligament damage that later required surgery. The client also suffered a concussion, post-concussion symptoms, bruising, abrasions, and other painful injuries that affected nearly every part of daily life.

Partners Steven Benvenisti, Esq., and Luis L. Haquia, Esq., together with the experienced NJ pedestrian accident legal team at Davis, Saperstein & Salomon, P.C., built the case by proving not only the seriousness of the client’s injuries, but exactly how and why the crash occurred. Rather than accepting a reduced settlement, they pursued every available path to compensation and retained an accident reconstruction expert to analyze sight distance, speed, stopping distance, vehicle damage, and driver response.

The expert performed nighttime visibility testing at the crash location using a surrogate pedestrian dressed similarly to the injured client. Based on those observations and photographs, the expert concluded that an attentive driver would have been able to see the pedestrian from at least 150 feet away before impact.

That reconstruction analysis became a critical part of the case, showing that even at the minimum calculated speed, the driver had enough time and distance to see the pedestrian, react, and stop before reaching the impact area. The expert further concluded that if the driver had been paying proper attention to the roadway, the collision could have been avoided altogether. The evidence also showed the driver failed to react before impact, which helped explain the force of the collision and the extent of the pedestrian’s injuries.

Steven Benvenisti, Esq., Luis L. Haquia, Esq., and the firm’s New Jersey personal injury attorneys used that expert analysis, together with their own investigation, review of the physical evidence, and examination of witness accounts, to construct a clear and well-supported case. Their work helped prove not only that the driver was at fault, but that he had enough time to stop his vehicle before the impact, contrary to the defense’s position.

The experienced New Jersey pedestrian accident attorneys analyzed, photographed, and documented the major damage to the vehicle, including a large dent on the hood and damage to the front grille area. They also examined witness accounts which helped place the pedestrian in the roadway and confirmed the severity and gravity of the impact.

The partners at Davis, Saperstein & Salomon, P.C., built a strong case through witness statements, crash investigation findings, traffic signal and dashcam footage, photographs of the vehicle damage, and expert reconstruction analysis. That compelling evidence, together with the attorneys’ strategic presentation of the facts, established negligence, supported every available avenue of compensation, and overcame efforts to minimize what happened, resulting in a $5.1 million settlement for the client and his family.
