Approaching the George Washington Bridge from Fort Lee, New Jersey

A 62-year-old woman was a passenger in a car approaching the George Washington Bridge in Fort Lee, New Jersey when the car was suddenly rear-ended by a large dump truck. Davis, Saperstein & Salomon, P.C. Partner Garry R. Salomon and Senior Associate Manuel B. Sameiro filed suit in the Superior Court of New Jersey, Bergen County, proving that the dump truck driver was negligent in failing to carefully operate his vehicle, and won the client a $825,000 settlement.

Our client suffered injuries to her head, right shoulder, neck, back, and right knee, and was diagnosed with a tendon tear and rotator cuff tendinosis on her right shoulder, disc bulges in her spine, bilateral facet arthrosis in her lumbar spine, and soft tissue edema in her right knee. She underwent a right shoulder arthroscopy, lumbar decompression, laminectomy, facetectomy, decompression and microdiscectomy to her lower back, as well as facet block injections and epidural steroid injections. Our client also completed several courses of physical therapy to improve her pain.

Davis, Saperstein & Salomon, P.C. retained medical experts to author narrative reports proving the permanent nature of our client’s injuries. To assess the financial loss, Partner Garry R. Salomon and Senior Associate Manuel B. Sameiro hired a vocational expert, who found that her injuries limited her work-life and resulted in a past and future value loss of approximately one hundred thousand dollars. The experts’ reports helped Partner Garry R. Salomon and Senior Associate Manuel B. Sameiro win the client a settlement for her injuries, pain & suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
