Over $1 Billion in Verdicts and Settlements

Hoboken Slip-and-Fall on Ice – $250,000 Settlement

A woman slipped and fell on uncleared black ice while walking through her apartment complex’s courtyard on Grand Street in Hoboken, New Jersey She hired Davis, Saperstein & Salomon, P.C. Partner Jeffrey Salomon as her injury lawyer, who filed suit in the Superior Court of New Jersey, Hudson County, proved that the property managers were negligent in failing to clear the ice, and won the client a $250,000 settlement.

Two of the women’s friends transported her to Jersey Medical Center in Jersey City, NJ, where she was diagnosed with fractures in her right ankle, which required an open reduction internal fixation (ORIF) surgery and months of physical therapy to treat.

Partner Jeffrey Salomon hired medical experts to author narrative reports describing the client’s injuries and their permanent nature. He also hired an engineering expert to inspect the property and review video footage to determine which party was legally responsible for the woman’s slip-and-fall. The expert found that her fall was caused by the property managers failing to salt, treat, and/or remove the black ice. With the help of these experts, Partner Jeffrey Salomon won the client a $250,000 settlement for her pain, injuries, and suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.

Medical Glossary

Open reduction and internal fixation (ORIF): A type of surgery used to stabilize and treat a broken bone. The procedure involves two steps: “open reduction” involves a surgeon creating a small incision in order to access the bone, and “internal fixation” involves a surgeon putting the bone back together with hardware like metal pins, plates, rods, or screws.
