$7,000,000 Pedestrian Accident Settlement

In November 2013, a Trader Joe’s employee in Westwood had just completed her shift and exited the grocery store to retrieve a cart so she could do some of her own shopping. All of a sudden, a Toyota Camry jumped a curb and plowed into the pedestrian. The woman was hurled into the building with her torso crashing through the store window and her leg stuck between the car and the rims of the shopping cart corral. She remained pinned by the car until she was able to be freed.

She was emergently rushed to Hackensack University Medical Center by helicopter where doctors were unable to save her lower leg and knee joint, forcing them to amputate her right leg above the knee. The woman also suffered from a collapsed lung and acute blood loss anemia, and later PTSD, anxiety, and frequent phantom limb pain. She went through a total of 13 surgeries after the accident, as well as many months of rehab and physical therapy.

The victim is now permanently disabled and still suffers from phantom limb, the painful and uncomfortable sensation of an amputated limb still being attached. The woman’s attorney Samuel L. Davis sued the older driver for negligent driving, which she admitted to. Davis was able to win a judgement of $7 million for the damages sustained by the victim.
