Pay Attention to Time Limits on Filing a New Jersey Car Accident Claim

New Jersey law requires a legal claim to be filed within a certain time period. This is called the statute of limitations. You must pay close attention to these deadlines. Exceptions may apply to these time limits based on the victim’s age or disability.

A survival action is different from a wrongful death claim. In a survival claim, the statute of limitations begins to run from the date of the accident, not on the date of the victim’s death. The discovery rule does not apply to wrongful death claims.
